WEB SITE TERMS AND CONDITIONS OF USE

These Web Site Terms and Conditions of Use (the “Online Terms”) govern your access to and use of the web pages, MyAccount, mobile application, text messaging service, email service, Washington Gas-branded social media, and any Washington Gas online platform (collectively, the “Site”) of the Washington Gas Light Company (“Washington Gas, “we”, or “us”). The Online Terms are in addition to your Washington Gas service agreement and any applicable terms and conditions (including, but not limited to, the MyAccount Terms and the Text Terms) for other services or equipment that you receive (collectively "Agreement") from Washington Gas. To the extent there is a conflict between these Online Terms and your Agreement these Online Terms will govern. 

Please read the Online Terms carefully before you start to use the Site. By using the Site, you accept and agree to be bound and abide by these Online Terms and our Privacy Policy, found at https://www.washingtongas.com/privacy or in the mobile application after log-in by clicking the More -> Legal -> Privacy Policy options or prior to login by clicking Legal -> Privacy Policy, incorporated herein by reference and you consent to all actions we take with respect to your information consistent with our Privacy Policy. If you do not want to agree to these Online Terms or the Privacy Policy, you must not access or use the Site. Additionally, by using the Site, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send to our Site may be read or intercepted by others, even if there is a special notice that a particular transmission (e.g., of credit card information) is encrypted.

Changes to the Online Terms
We may revise and update the Online Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Online Terms means that you accept and agree to the changes. You are expected to check this page periodically so that you are aware of any changes, as they are binding on you.

Reliance on Information Posted
The information presented on or through the Site has been compiled and is maintained by us but we make no representation as to the completeness or accuracy of the information it contains. You should be aware that some information may be incomplete, may contain errors or may be outdated. We reserve the right to add, modify or delete any information contained in our Site without notice to you. We specifically disclaim any duty to update our Site.  You are responsible for assuring that all the information provided by you as part of the Online Services is correct, accurate and complete.

Device Compatibility
Our Site function on certain devices and operating systems. You acknowledge that your operating system and future operating system upgrades to your device may or may not be compatible with our Site. You are solely responsible for ensuring that your operating system functions correctly and is compatible with our Site.

User Conduct

You may use our Site for lawful purposes only and in compliance with all applicable laws and regulations. You are prohibited from using our Site, or transmitting to or through our Site, any unlawful, threatening, obscene, defamatory, libelous, harassing, pornographic, hateful (ethnically or racially) or otherwise objectionable material, or any material that would contribute to a civil or criminal offense, infringe on any intellectual property right or otherwise violate any law. You will not take any action that interferes or attempts to interfere with the intended functioning of our Site, including submitting or transmitting any software or other computer files that contain a virus or other harmful component, or otherwise impairing or damaging our Site. You will not impersonate any person or entity or misrepresent your identity or affiliation with any person or entity when using our Site, nor will you attempt to gain unauthorized access to any portion or features of the Site or services, to any other systems or networks connected to the Site, to any of our servers, or to any of the services offered on or through the Site, including but not limited to by hacking, password “mining,” or any unauthorized means. 

Viewing materials on our Site, and downloading such, is permitted only for your private use. Such permission is subject to you retaining all copyright, trademark and other proprietary notices contained in the original materials on any copies you make of the materials. You may not modify the materials on our Site in any way or reproduce or publicly display, distribute, or otherwise use them for any public or commercial purpose. Any use of these materials on any other web site or networked computer environment for any purpose is prohibited, unless specifically approved by us in advance in writing. You may not use any automated means to collect information or content from or otherwise access our Site, including but not limited to through the use of technical tools known as robots, spiders, or scrapers, without our specific prior written permission.

We have the right to disable any user account, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Online Terms.

Site Access
You are responsible for both:
· Making all arrangements necessary for you to have access to the Site.
· Ensuring that all persons who access the Site through your internet connection are aware of these Online Terms and comply with them.

As a condition of using the Site, you agree to promptly notify us of any unauthorized use of your account or any other breach of security with respect to your account. We will not be liable for any loss or damage arising from unauthorized use of your account.

To access the Site or some of the resources it offers, you may be asked to provide certain registration details or other information. This information will include certain personal information, including, but not limited to, your Washington Gas account number, first and last name, date of birth, social security number, home or business address, email address, and telephone number. You agree to provide true, accurate, current, and complete information about yourself as requested in the registration form. You also agree to update the information about yourself as necessary to keep it current and accurate.

Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Washington Gas, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The Washington Gas name, the terms and all related names, logos, product and service names, designs, and slogans are trademarks of Washington Gas or its affiliates or licensors. You must not use such marks without the prior written permission of Washington Gas. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

We do not own any content submitted by you (“Your Content”). You retain all of your ownership rights in Your Content. By submitting Your Content to the Site, you grant Washington Gas a worldwide, non-exclusive, royalty free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content. We will also be free to use any ideas, concepts, know-how, or techniques contained in information that you send to us for any purpose including, but not limited to, developing, manufacturing, and marketing products and services.

Linking
You may link to the Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express written consent. You may link only to the home page; links to other pages on the Site are expressly prohibited without our express written consent. You may not establish a link from any web site that is not owned by you, nor may you take any action with respect to the materials on the Site that is inconsistent with any other provision of these Online Terms.

Further:
Links must be only text-based. You may not use inline links, anchor links, deep links, or any of our logos or other marks as links, unless expressly approved by Washington Gas in writing.
Framing is not permitted under any circumstances.
In linking to the Site, you may not misrepresent your relationship with us. No links to the Site may be used in a manner that implies or suggests that we approve or endorse you, your web site or application, or your goods and services, except as we may have expressly agreed to separately with you in writing.
Washington Gas has no responsibility or liability for any content appearing on the web site or application from which you link to the Site. You agree to indemnify, defend, and hold harmless (all at your sole cost) Washington Gas from and against any and all claims arising out of or based on such web site or application that includes your links.

We reserve the right to withdraw linking permission, or change this linking policy, at any time without notice.

Links from the Site
If the Site contains links to other sites and resources provided by third parties, these links are provided for your convenience only. This includes links contained in advertisements, including banner advertisements and sponsored links. We have no control over the contents of those sites or resources and we accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party web sites linked to this Site, you do so entirely at your own risk and subject to the terms and conditions of use for such web sites.

Disclaimer of Warranties
You understand that we cannot and do not guarantee or warrant that the Site, or files available for downloading from the internet or the Site, will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE SITE, MYACCOUNT, THE TEXT ALERT SERVICE, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEB SITE LINKED TO IT. WE WILL NOT BE RESPONSIBLE FOR ERRORS, OMISSIONS, INTERRUPTIONS, DELETIONS, DEFECTS OR DELAYS IN THE OPERATION AND TRANSMISSION OF OUR SITE, ANY SERVICES OR RELATED CONTENT, OR FOR COMMUNICATION LINE FAILURES ASSOCIATED WITH THE OPERATION OF OUR SITE.

WASHINGTON GAS DOES NOT WARRANT THAT THE PAPERLESS BILLING INFORMATION, PROCESSES, OR SERVICES WILL BE UNINTERRUPTED, ACCURATE, COMPLETE, USEFUL, FUNCTIONAL, OR BUG-OR-ERROR-FREE. IF APPLICABLE STATE LAW DOES NOT ALLOW THE DISCLAIMER OF CERTAIN IMPLIED WARRANTIES, THE RELEVANT PORTIONS OF THE ABOVE EXCLUSION MAY NOT APPLY.

Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL WASHINGTON GAS, ITS PARENT AND AFFILIATE COMPANIES, AND EACH OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEB SITES LINKED TO IT, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Miscellaneous
All matters relating to the Site and these Online Terms, and all matters arising out of or related thereto, including all tort claims, will be governed by and interpreted in accordance with the substantive laws of the Commonwealth of Virginia without reference to conflicts of law. Any lawsuit, claim, dispute, or other action related to this the Site, these Online Terms, and the Agreement must be brought only in an appropriate federal or state court sitting in the Commonwealth of Virginia. The parties specifically consent to the personal jurisdiction of the federal or state courts sitting in the Commonwealth of Virginia with regard to any such action and they specifically agree that the sole appropriate venue for any such lawsuit is in the federal or state courts sitting in the Commonwealth of Virginia.

No waiver by Washington Gas of any breach of these Online Terms will be held to be a waiver of any other or subsequent breach and shall not limit Washington Gas’ rights with respect to such breach or any subsequent breaches.

Use of the Site is at your sole risk. Although Washington Gas has endeavored to create a secure and reliable Site, the confidentiality or security of any communication transmitted or accessible over the internet cannot be guaranteed. Washington Gas does encrypt your personal information on our systems and in transmission and complies with all applicable laws in handling such information. Washington Gas and its affiliates are not responsible for the security of any information transmitted or accessed using the internet. Actual or attempted unauthorized use of the Site may result in criminal and/or civil prosecution.

Washington Gas reserves the right to change the Online Terms. You can review the most current version of the Online Terms at any time by visiting https://www.washingtongas.com/terms. Updates or changes to the Online Terms will be effective when posted on the Site. Your continued use of the Site or any services provided hereunder after any changes in such terms and conditions shall constitute your consent to such changes. Washington Gas reserves the right to change, modify or discontinue, temporarily or permanently, the Site or any portion thereof, without notice. You agree that Washington Gas shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site.

MYACCOUNT AND MOBILE APPLICATION USE AND ACCESS TERMS AND CONDITIONS

You may use Washington Gas' online utility bill account access system ("MyAccount") and its mobile application (the "Mobile App”) only if you are a customer of Washington Gas and have agreed to participate in MyAccount by properly registering a username and password consistent with the Online Terms. All use of MyAccount and the Mobile App is subject to these MyAccount and Mobile Application Use and Access Terms and Conditions (the “MyAccount Terms”) in addition to the Online Terms. In the event of any conflict between the MyAccount Terms and the Online Terms, the Online Terms will control.

MyAccount may be accessed by certain Washington Gas services, including Washington Gas' web site and Mobile App. We reserve the right to withdraw or amend MyAccount, and any service or material we provide on or through MyAccount, in our sole discretion without notice. We will not be liable if for any reason all or any part of MyAccount or the Mobile App is unavailable at any time or for any period. From time to time, we may restrict access to some parts of MyAccount and/or the Mobile App, to users, including registered users. Further, discontinuing MyAccount will no longer allow you access to online services specific to your Washington Gas account(s).

You agree to accept legal and other notices (such as notices about changes to your Washington Gas service agreement, rate plan, equipment, services, features, or equipment installment plan) electronically.

By Accepting these MyAccount Terms, you agree and represent that you (i) can access and read these MyAccount Terms, and (ii) have the authority to accept and agree to the MyAccount Terms.

Password Guidelines
The unique username and password (collectively, "Password") selected by you to access MyAccount must be held on a confidential basis. Authorized guest users, or unauthorized users with your Password will have access to MyAccount and all the services available within the account. As a condition for your use of, and access to, MyAccount, you are solely responsible for any claims, losses, damages, expenses and costs incurred (a) by the use of your Password by others, or (b) by any authorized guest users. You are solely responsible for maintaining the privacy and usage of the Password against improper disclosure. Washington Gas reserves the right to reset any Passwords.

If you have forgotten or lost your Password, online services are available to assist you in resetting it. If you need assistance, contact Washington Gas by email at customersupport@washgas.com or by calling Customer Support at 844-WASHGAS (844-927-4427) Mon: 8 a.m. to 8 p.m.; Tue - Fri: 8 a.m. to 6 p.m.; or Sat: 8 a.m. to 5:00 p.m.

Emails from Washington Gas
By registering with MyAccount, you agree to receive automatic email notifications related to online services, MyAccount, your service agreement, and/or any other services that Washington Gas may provide to you. Additionally, you may receive notifications via email regarding construction and maintenance updates, activities pertaining to our programs or services, providing surveys to help improve our customer service, notifying customers of special events, sharing energy and safety education information, and providing offers related to our products and services that may be of interest to you.

Contact Information
As a MyAccount user, it is your responsibility to ensure that the contact and other required information in your user profile is current and accurate, and updated promptly if necessary, including your name, address, phone number and email address. Changes can be made within the MyAccount at https://my.washingtongas.com/portal/account.aspx  portal by going to the MyAccount menu and selecting My Profile or by contacting Washington Gas via email at customersupport@washgas.com or by calling Customer Service Support at 844-WASHGAS (844-927-4427).

You agree that the information you provide to Washington Gas can go through a verification process by email and/or phone (e.g., multifactor authentication).

Service Order
In submitting a service request, you, the customer, agree to take and pay for gas service from Washington Gas in accordance with this application and the rates, terms and conditions contained in Washington Gas' tariffs as amended from time to time and available for inspection at any business office of Washington Gas and at https://www.washingtongas.com/my-account/account-services-support/current-rates.

Location-Based Services
Washington Gas provides location services within its Mobile App. These enable a customer's mobile device location to be determined. Please see our Privacy Policy [https://www.washingtongas.com/privacy] for information on what location-based data we collect as a result of use of our location-based services.

Location services are an integral part of certain Washington Gas services, enabling customers' mobile device location information to be displayed on a map, be associated with received messages, and included with alerts, status, and service request updates. The mobile device and/or the Mobile App will allow the customer to enable or disable location services.

The following terms of use apply for location services:
1. For the location-based aspect of a service to operate correctly, Washington Gas, or a Washington Gas third-party vendor, must be permitted to communicate with your phone/tablet and/or computer. By doing so, Washington Gas will attempt to identify your location. This may require the collection, use and sharing, among other things of precise coordinate data, including real time geographic location of your device, with Washington Gas partners, licensors, and licensees, in accordance with the terms as set out in our Privacy Policy. The subject location information is captured when the customer uses location services and will not be used outside of the customer's use of the location service.
2. You expressly agree, by using location services, that you authorize Washington Gas, to collect and use your location data as a part of Washington Gas' services. Where applicable, you may at any time disconnect your device from the location-based aspect of the services.
3. Washington Gas does not represent that its location services are suitable for emergency situations. They should not be relied upon as such. Washington Gas shall not be liable for any reliance placed by an individual on its locational services, especially in the event of death or serious injury.
4. You accept that the service accuracy of the location information can vary depending on your situation, e.g., city versus rural location.
5. You are responsible for managing the processing, use, and security of location information. You must use the location service associated location information within the law and acknowledges that the collection and use of sensitive personal data using location information is subject to relevant privacy and data protection laws.
6. Where Washington Gas has reasonable grounds for suspecting (a) misuse of the location service or (b) failure by the customer to either follow such instructions or adhere to Washington Gas’ Online Terms, Washington Gas may suspend the location service. Repeated misuse or failures may result in the location service being withdrawn.

Push Notifications
We may provide you with push notifications, alerts, and other messages related to the Mobile App and/or Washington Gas' services. After downloading the Mobile App, push notifications/alerts will be automatically sent to you. If you no longer wish to receive push notifications/alerts from the Mobile App, you may opt out by changing the notification settings on your mobile device.

E-mail and Fax Communications
The information in electronic mail (email) or fax communication from Washington Gas may contain confidential information, which is the property of the sender. Email or fax communication from Washington Gas is intended solely for the addressee and access by anyone else is not authorized. If you are not the intended recipient, you are hereby notified that any disclosure, copying, or distribution of the contents of an email or fax transmission from Washington Gas or the taking or omission of any action in reliance thereon or pursuant thereto, is prohibited, and may be unlawful. If you receive an email or fax from Washington Gas in error, please notify us immediately by email and destroy the communication, any attachments, and all copies thereof. Washington Gas does not guarantee the privacy or security of information transmitted by email or other unsecure electronic means (including facsimile (fax)). By choosing to send or receive information, including confidential or personal identifying information, via unencrypted email or fax, you consent to accept any associated risk.

You can opt in or opt out of additional email notifications regarding payment reminders and your bill status by going to the Menu - MyAccount -> Notification Preferences [https://my.washingtongas.com/portal/NotificationPreference.aspx] or via the Menu – MyAccount -> Notification Preferences section of the Mobile App.

Failure to deliver billing or payment reminders does not modify or absolve you of your payment obligations. In the event you do not receive a payment reminder, it is your responsibility to log into MyAccount and check on your paperless bills and account balance(s).

Changes made to your "Billing/Payment Notification Preferences" do not affect your enrollment status in paperless billing and will not change the email address associated with your MyAccount, nor prevent Washington Gas from sending email communications related to your MyAccount.

Automatic Payment Plan

Program Qualifications and Restrictions

Customers are eligible for enrollment in Washington Gas' Automatic Payment Plan ("APPL") subject to meeting the following requirements:
You must have a current/valid account at a U.S. financial institution where the payment will be withdrawn.
Your Washington Gas account must be an active account and your account must not have been removed from the APPL by Washington Gas in the past twelve (12) months.

Payment Obligations
On your due date, our third-party vendor will deduct your APPL payment from the bank account you have designated. Your billing statement will indicate that it is being paid through the APPL when this service is activated. If Washington Gas makes a billing adjustment to the account, Washington Gas will cancel the withdrawal and establish a new withdrawal for the amount and due date as indicated on the revised bill.

If two (2) requests are returned for insufficient funds during any given twelve (12) month period, you may be excluded from using the APPL to make payment. If you need to update your bank account information, you can do so online through MyAccount. However, to the extent this information requires updating, and if such updates are not made prior to the applicable payment deadline, all applicable additional charges, including, but not limited to, late fees, may be assessed. If a transaction is refused by your financial institution for any reason, including, but not limited to, insufficient funds, closed account, or unauthorized account, Washington Gas will not be able to process your payment. Your Washington Gas account may be subject to additional charges if your payment is rejected, reversed, or refused by your financial institution.

By enrolling in the APPL, you authorize Washington Gas to initiate an ACH monthly debit to your bank account as detailed above.

It is your responsibility to:
Ensure there are sufficient funds available in your bank account to meet each withdrawal on the due date. If there are insufficient funds in your account, your financial institution and/or Washington Gas may charge you a fee and/or interest. You are solely responsible for paying any fee and/or interest charged by your financial institution or Washington Gas. Check your account statement to verify that the amounts debited from your account are correct.
Advise us if the payment account is transferred or closed, or if the account details change, no later than two (2) business days before the debit date.
Arrange an alternate payment method if you cancel the scheduled withdrawal.

Terminating Participation in the APPL
Participation in the APPL is entirely optional. We reserve the right to discontinue accepting APPL payments at any time, for any reason, and without prior notice. We may send notification of termination of APPL any time after the termination is effective. We also may temporarily discontinue accepting APPL payments, at our sole discretion. Termination does not affect your rights and obligations for APPL payments prior to termination.

In the event that you wish to revoke your authorization for Washington Gas to make ACH monthly debits to your bank account as detailed above, you must cancel your Automatic Payment Plan enrollment at least two business days in advance of your scheduled payment by going online or by calling customer support at 844-WASHGAS (844-927-4427).

The terms governing the APPL do not supersede, modify or in any way mitigate your obligation to be bound by and comply with the MyAccount Terms or the Online Terms.

Paperless Billing

Enrollment Requirements
The Paperless Billing option requires an active Washington Gas account number, a valid email address, and to be logged into or create a MyAccount. You may enroll in Paperless Billing at any time. Please be aware that if you transfer your gas service to another address, Paperless Billing will also transfer over to the new address. In the event you do not wish to have Paperless Billing transfer, please cancel Paperless Billing by either signing in to your MyAccount or by calling Customer Service. You may print a paper copy of your paperless bill at any time

Bill Delivery
Upon enrollment in Paperless Billing, one last paper bill may be delivered. Regardless of our participation in Paperless Billing, disconnect, final, and special billings will always be mailed to your address of record.

Washington Gas will use its best efforts to promptly deliver your paperless bills. We will send an email notification of your paperless bill to the email address listed on your account. It is your sole responsibility to ensure that this information is accurate. If you do not receive a notification, it is your responsibility to log into MyAccount and check your paperless bills and account balance(s). You agree to hold Washington Gas harmless for any delay or failure to deliver or receive the paperless Bill notice.

Payment
You must pay the amount due listed in your paperless bill by the due date in order to avoid late fees, collection activity, service interruption.

Termination/Cancellation of Paperless Billing
You may terminate Paperless Billing at any time by logging into MyAccount. After you terminate Paperless Billing, future bills will be mailed to your current address on file with Washington Gas. Please make sure to pay your final paperless bill by the due date. You can check your current account balance at https://my.washingtongas.com/portal. Washington Gas reserves the right to deny or cancel paperless billing at any time in its sole discretion. Neither termination nor cancellation shall affect your liability or obligations under your service agreement with Washington Gas or under these Online Terms.

Non-Delivery of Paperless Bills
If emails are returned as undeliverable to Washington Gas, Washington Gas reserves the right to terminate you from Paperless Billing and return to sending you a paper bill. You may enroll again at any time after correcting any email address errors through MyAccount.

System Compatibility

If you have elected to receive your paperless bill in Portable Document Format (PDF), you may need to upgrade your computer’s PDF reader program to view your paperless PDF bill. If you are having trouble accessing or viewing your paperless bill, please contact Customer Service. Please note that some service providers block e-mail from senders who are not listed in contacts or on safe lists, so you may not receive your paperless bill notice unless you specifically add Washington Gas to your contacts or safe list.

Discrepancies
For any questions regarding your paperless billing transactions, contact Washington Gas by email at customersupport@washgas.com or by calling 844-WASHGAS (844-927-4427) Mon: 8 a.m. to 8 p.m.; Tue –Fri: 8 a.m. to 6 p.m.; Sat: 8 a.m. to 5:00 p.m. The terms governing paperless billing do not alter your liability or any obligations between you and Washington Gas concerning your utility usage and any other Washington Gas products and services. Any disputes regarding the accuracy or completeness of your paperless bill shall be subject to the dispute resolution terms and conditions in the service agreement for your Washington Gas account and service.

Online Payment

Program Qualifications and Restrictions
All eligible residential and commercial customers are permitted to utilize Washington Gas' Online Payment service ("Online Payment") via MyAccount if the following requirements are met:
You must have a current/valid U.S. bank account at a financial institution, or a valid credit or debit card where the payment will be withdrawn. Payments will be withdrawn by our third-party vendor on the date specified.
Your Washington Gas account must be active or have a balance owing to make an Online Payment.

Customer Requirements
By clicking “Submit” on the Mobile App you are confirming that you accept the MyAccount Terms (and any future modifications thereof) and agree that, by scheduling a payment via Online Payment, you authorize your financial institution and Washington Gas to initiate debit(s), credit(s), or correction entries for such payments. Further, you Washington Gas to initiate a one-time ACH to your bank account as detailed above. In the event that you wish to revoke this authorization, you must cancel your payment at least two (2) business days in advance of your scheduled payment by going online or by calling customer support at 844-WASHGAS (844-927-4427).Your acceptance of the MyAccount Terms is an affirmative representation that you have all necessary rights, power, and authority to authorize each such payment and that you will take such steps as your financial institution requires to make such authorization.

It is your responsibility to ensure there are sufficient funds available in your bank account to meet each scheduled Online Payment. If there are insufficient funds in your account, your financial institution and Washington Gas may charge you a fee and/or interest. You are solely responsible for paying any fee and/or interest charged by your financial institution or Washington Gas. Check your bank account statement to verify that the amounts debited from your account are correct. Any overpayments resulting in a credit balance cannot be refunded but will be applied as a credit on your Washington Gas account. Requests for refunds due to overpayment should be directed to your financial institution which may charge a fee associated with the refund request.

Payment Obligations
Payments through MyAccount will post to your account the same day. You are solely responsible for making payments prior to the due date, and you are solely responsible for any late fees charged by Washington Gas for late payments. Late fees for any payments made using Online Payment are the same as the late fees charged for mailed payments. Online Payment is designed to be available seven (7) days a week, twenty-four (24) hours a day, and Washington Gas will endeavor to update account balance and activity information daily. However, Washington Gas shall not be liable for any inability to access Online Payment, or for Washington Gas' failure to update any information, for whatever reason.

Washington Gas does not charge you a convenience fee for using Online Payment. However, your financial institution and/or our third-party vendor(s) may charge you fees related to your scheduled payment, including convenience fees, transaction fees, or fees for attempting payments without sufficient funds. If the transaction is refused by your financial institution for any reason, including, but not limited to, insufficient funds, closed account, or unauthorized account, Washington Gas will not be able to process your payment. Your Washington Gas account may be subject to additional charges if your payment is rejected, reversed, or refused by your financial institution.

If you save your banking information for reoccurring use in MyAccount and need to update this information, you can do so online through MyAccount or on the Mobile App. However, to the extent this information requires updating, and such updates are not made prior to the applicable payment deadline (as discussed in detail above), all applicable additional charges, including, but not limited to, late fees, may be assessed.

Unauthorized or Disputed Payments
If you believe that someone has made an unauthorized payment through Online Payment without your permission, contact your financial institution immediately. You are solely responsible for any unauthorized payments, although your financial institution may provide some form of fraud protection.

In case of disputes or questions about your Online Payment, contact Washington Gas by email at customersupport@washgas.com or by calling 844-WASHGAS (844-927-4427) Mon: 8 a.m. to 8 p.m.; Tue –Fri: 8 a.m. to 6 p.m.; Sat: 8 a.m. to 5:00 p.m.. Washington Gas must hear from you within sixty (60) days after the first bank statement on which the problem appeared was sent to you. Please provide your name and Washington Gas account number, describe the error or transfer about which you are unsure, why you believe there is an error, and the dollar amount of the suspected error.

Washington Gas will inform you as to the result of the investigation within ten (10) business days after Washington Gas hears from you and will correct any error promptly. If more time is needed, however, Washington Gas may take up to forty-five (45) days to investigate your complaint or questions. If no error is found, Washington Gas will contact you within three (3) business days after the investigation is completed.

Termination
Participation in Washington Gas' Online Payment is entirely optional. Washington Gas reserves the right to suspend or discontinue accepting online payments at any time, for any reason without prior notice. Washington Gas will attempt to provide you with prior notice of suspension or termination of Online Payment, but Washington Gas will not be liable for any failure to do so. Neither termination nor discontinuation of Online Payment shall affect your liability for transactions initiated through this service.

Exclusions Of Warranties
MYACCOUNT AND THE MOBILE APPL, AND ALL INFORMATION CONTAINED THEREIN, ARE EACH PROVIDED "AS IS","WITH ALL FAULTS", AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMIT, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR USE OF MYACOUNT AND/OR THE PAPERLESS BILLING SERVICE. WASHINGTON GAS DOES NOT WARRANT THAT THE PAPERLESS BILLING INFORMATION, PROCESSES, OR SERVICES WILL BE UNINTERRUPTED, ACCURATE, COMPLETE, USEFUL, FUNCTIONAL, OR BUG-OR-ERROR-FREE. IF APPLICABLE STATE LAW DOES NOT ALLOW THE DISCLAIMER OF CERTAIN IMPLIED WARRANTIES, THE RELEVANT PORTIONS OF THE ABOVE EXCLUSION MAY NOT APPLY.

Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL WASHINGTON GAS, ITS PARENT AND AFFILIATE COMPANIES, AND EACH OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, MYACCOUNT AND THE MOBILE APPL, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Dispute Resolution
A. ALL DISPUTES ARISING OR RELATED TO THE MYACCOUNT TERMS OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU, ON THE ONE HAND, AND THE COMPANY, ITS PARENT OR SUBSIDIARY COMPANIES, ITS SUPPLIERS OR ITS VENDORS, ON THE OTHER HAND, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING RESOLUTION BEFORE THE VIRGINIA STATE CORPORATION COMMISSION, THE PUBLIC SERVICE COMMISSION OF THE DISTRICT OF COLUMBIA, OR THE MARYLAND PUBLIC SERVICE COMMISSION, AS APPLICABLE. YOU AGREE THAT WASHINGTON GAS AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY. YOU AGREE THAT ANY DISPUTE UNDER THESE MYACCOUNT TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.
B. TO THE EXTENT THE FOREGOING CLAUSE IS DETERMINED TO BE INVALID OR UNENFORCEABLE BY A COURT, THEN IN THAT EVENT, AND EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THESE MYACCOUNT TERMS OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU, ON THE ONE HAND, AND WASHINGTON GAS, ITS PARENT OR SUBSIDIARY COMPANIES, ITS SUPPLIERS OR ITS VENDORS, ON THE OTHER HAND, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY AND YOU AGREE THAT WASHINGTON GAS AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY. YOU AGREE THAT ANY ARBITRATION UNDER THESE MYACCOUNT TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.
C. Any arbitration conducted pursuant to Paragraph "B" of this section will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as amended by these MyAccount Terms. The arbitrator will conduct hearings, if any, by teleconference or videoconference, rather than by personal appearances, unless the arbitrator determines upon request by you or by us that an in-person hearing is appropriate. Any in-person appearances will be held at a location which is reasonably convenient to both parties with due consideration of their ability to travel and other pertinent circumstances. If the parties are unable to agree on a location, such determination should be made by the AAA or by the arbitrator. If you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, the Company will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. The arbitrator's decision will follow the terms of this Agreement and will be final and binding. The arbitrator will have authority to award temporary, interim, or permanent injunctive relief, or relief providing for specific performance of this Agreement, but only to the extent necessary to provide relief warranted by the individual claim before the arbitrator. The award rendered by the arbitrator may be confirmed and enforced in any court having jurisdiction thereof. With the exception of any of the language above in this paragraph B of the Dispute Resolution provision relating to the waiver of class and representative actions, if a court decides that any part of this Dispute Resolution provision is invalid or unenforceable, the other parts of this Dispute Resolution provision shall still apply. If a court decides that any aspect of the language above in this paragraph B of the Dispute Resolution provision relating to the waiver of class and representative actions is invalid or unenforceable, then the entirety of this Dispute Resolution provision shall be null and void. The remainder of the Agreement will continue to apply and be unaffected by this severability provision.
D. Notwithstanding any of the foregoing, nothing these MyAccount Terms will preclude you from bringing issues to the attention of federal, state, or local agencies and, if the law allows, they can seek relief against us on your behalf.

Miscellaneous
All matters relating to MyAccount, the Mobile App, and these MyAccount Terms, and all matters arising out of or related thereto, including all tort claims, will be governed by and interpreted in accordance with the substantive laws of the Commonwealth of Virginia without reference to conflicts of law. 

No waiver by Washington Gas of any breach of the MyAccount Terms will be held to be a waiver of any other or subsequent breach and shall not limit Washington Gas’ rights with respect to such breach or any subsequent breaches. 

Washington Gas has no responsibility for any failure or error in its Online Services and/or MyAccount, including without limitation, any interruption, omission, mistake, malfunction, or delay related thereto. Washington Gas makes no representation that any data posted is suitable for any particular purpose or use. You should not assume that the information within MyAccount is constantly updated or otherwise includes recent information. All information contained in MyAccount is provided "as is" and "as available," although Washington Gas will use its reasonable efforts to post the best data that is readily available. Some of the information presented within MyAccount is based on estimates and projections. Washington Gas reserves the right in its sole opinion to prevent any user from accessing MyAccount in connection with services provided by Washington Gas.

MyAccount and the Mobile App will be operated and used at all times subject to applicable laws, rules, regulations and decisions of federal and state governmental authorities having jurisdiction, as in effect from time to time, including without limitation, the applicable public utilities commissions.

Washington Gas' currently-authorized tariffs are incorporated by reference as follows:
The Virginia Gas Tariff is hereby incorporated by reference for all Virginia customer accounts.
The Maryland Gas Tariff is hereby incorporated by reference for all Maryland customer accounts.
The District of Columbia Gas Tariff is hereby incorporated by reference for all District of Columbia customer accounts.

If any part of the MyAccount Terms conflicts with the applicable tariff, the terms of the tariff shall control. No action by you or Washington Gas may amend, supplement, change, or replace any part of this Agreement or tariff that is incorporated by reference. All currently-authorized tariffs can be viewed at https://www.washingtongas.com/my-account/account-services-support/current-rates.

Use of MyAccount, the Mobile App, and any Washington Gas service accessed thereto, is at your sole risk. Although Washington Gas has endeavored to create a secure and reliable service, the confidentiality or security of any communication transmitted or accessible over the internet cannot be guaranteed. Washington Gas does encrypt your personal information on our systems and in transmission and complies with all applicable laws in handling such information. Washington Gas and its affiliates are not responsible for the security of any information transmitted or accessed using the internet. Actual or attempted unauthorized use of MyAccount, the Mobile App, or the Site may result in criminal and/or civil prosecution.

Washington Gas' use of your information shall be in accordance with Washington Gas' Privacy Policy, which may be viewed at https://www.washingtongas.com/privacy. We may share information we collect about you, except credit bureau information, with outside companies that are assisting us with servicing your account. Our agreements with these outside companies (service providers) require that they protect this information; they are only authorized to use such information to carry out the services they are performing for Washington Gas.

Washington Gas reserves the right to change the MyAccount Terms. You can review the most current version of the MyAccount Terms at any time at. https://my.washingtongas.com/portal/  Updates or changes to the MyAccount Terms will be effective when posted on the Site. Your continued use of MyAccount, the Mobile App, or any services provided hereunder after any changes in such terms and conditions shall constitute your consent to such changes. Washington Gas reserves the right to change, modify or discontinue, temporarily or permanently, MyAccount, the Mobile App, or any portion thereof, without notice. You agree that Washington Gas shall not be liable to you or to any third party for any modification, suspension, or discontinuance of MyAccount or the Mobile App. 

Additional terms and conditions may apply to a specific service provided hereunder.

These MyAccount Terms do not supersede, modify or in any way mitigate your obligation to be bound by and comply with all applicable tariffs, rules and regulations related to your service.

TEXT-MESSAGE-SPECIFIC TERMS AND CONDITIONS

Your access to, and use of, the Washington Gas mobile communication tools and text messaging services (collectively, "Text Alerts Service") is subject to these Text-Message-Specific Terms and Conditions (the “Text Terms”) and all applicable laws and regulations, in addition to the Online Terms and the MyAccount Terms, as applicable. By opting into text notifications on MyAccount web or the Mobile App, accessing and using SMS or MMS texting, entering prompts to opt in during a call with our automated telephone system, and/or providing verbal consent to a Washington Gas customer service representative, you accept, without limitation or qualification, these Text Terms. In the event of any conflict between the Text Terms and the Online Terms, the Online Terms will control.

Washington Gas offers access to account information, billing, and payment notifications, service-related information (e.g., threatened interruptions of service, actual interruptions of service, and service restoration information), programs, and natural gas safety messages via recurring SMS, MMS text alerts, and pre-recorded and auto-dialed calls. 

Enrollment in our Text Alerts Service is limited to Washington Gas customers and their authorized designees. Enrollment requires a customer (or their designee) to provide his or her own mobile phone number with an area code within the fifty United States or the District of Columbia. By enrolling in our Text Alerts Service, you agree to these Text Terms, which become effective immediately upon your enrollment.

You acknowledge that text alerts will be sent to the mobile phone number you provide to Washington Gas. Such text alerts may include limited personal information about your account. You acknowledge that anyone with access to your mobile phone or carrier account will also be able to see this information. Once you enroll, the frequency of text alerts we send to you will vary. You will typically receive text alerts when we have information for you about your account and interruptions of service.

To manage your text notification preferences and contact information, go to Menu - MyAccount -> Notification Preferences " or the Menu - MyAccount -> Notification Preferences section of the Mobile App.

Participation in our text alerts service is not required for gas service.

You acknowledge and understand that messages are sent without encryption, which presents some security risk.

Termination
You may opt out of the Text Alerts Service at any time. To stop receiving Washington Gas text alerts, text STOP to the number upon which you are receiving the text alerts. Texting STOP to the number you are receiving Washington Gas text alerts from will opt you out of any and all future Washington Gas text messages. Alternatively, you may opt out of our text alerts service by managing your Notification Preferences at Menu - MyAccount -> Notification Preferences [https://my.washingtongas.com/portal/NotificationPreference.aspx] or calling Washington Gas’ Customer Service Department at 844-WASHGAS (844-927-4427) during business hours.

After you submit a request to unsubscribe, you will receive one final text alert confirming that you will no longer receive Washington Gas text alerts. No additional Washington Gas text alerts will be sent unless you reactivate your enrollment in the Text Alerts Service by texting START to the number upon which you are receiving Washington Gas text alerts or by managing your Notification Preferences at https://my.washingtongas.com/portal/NotificationPreference.aspx

Texting Commands
For questions about our text alerts service, text the word HELP to the number you are receiving Washington Gas text alerts from. Washington Gas text alerts may come from short codes and we may change, add or remove short codes as necessary.

Text Quiet Hours
You may opt in to "Text Quiet Hours" for "Billing and Payment" notifications. By opting in, you request that Washington Gas not send "Billing and Payment" related text notifications between the "From" and "To" timeframe you select. For text notifications scheduled to be sent during the customer selected "Text Quiet Hours," the text will be held and sent after the "Text Quiet Hours" period is over. Certain texts, including those sent for multi-factor authentication or that are triggered upon certain web profile updates, will be sent regardless of timing, as these are customer triggered.

No Warranties
WASHINGTON GAS' TEXT ALERTS SERVICE IS OFFERED ON AN "AS IS" BASIS AND: (1) MAY NOT BE AVAILABLE IN ALL AREAS AT ALL TIMES; AND (2) MAY NOT CONTINUE TO WORK IN THE EVENT OF PRODUCT, SOFTWARE, COVERAGE OR OTHER SERVICE CHANGES MADE BY YOUR WIRELESS CARRIER. WASHINGTON GAS MAY CHANGE OR DISCONTINUE ANY PORTION OF ITS TEXT ALERTS SERVICE WITHOUT NOTICE OR LIABILITY TO YOU. WASHINGTON GAS RESERVES THE RIGHT TO CEASE DELIVERY OF TEXT ALERTS TO ANY PERSON AT ANY TIME IN ITS SOLE DISCRETION. YOU AGREE THAT WASHINGTON GAS SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION, OR DISCONTINUANCE OF THE TEXT ALERT SERVICE.

WASHINGTON GAS DOES NOT GUARANTEE THAT THE USE OF SMS TEXTING, MMS TEXTING, OR AND PRE-RECORDED AND AUTO-DIALED CALLS WILL MEET YOUR PERFORMANCE REQUIREMENTS OR BE UNINTERRUPTED OR ERROR-FREE. WE MAKE NO WARRANTIES OR REPRESENTATIONS AS TO THE USE OR RESULTS OF USE IN TERMS OF SECURITY, DATA PRIVACY, DATA LOSS, CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. WASHINGTON GAS WILL NOT CORRECT ANY ERRORS RELATED TO YOUR USE OF SMS TEXTING, MMS TEXTING, OR AND PRE-RECORDED AND AUTO-DIALED CALLS. YOU ASSUME ALL RISKS AS TO THE QUALITY AND PERFORMANCE OF SMS AND MMS TEXTING, INCLUDING BUT NOT LIMITED TO HEALTH RISKS. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DEATH, PERSONAL INJURY, OR ENVIRONMENTAL DAMAGE YOU CAUSE TO YOURSELF, OR OTHERS, BY YOUR USE OF SMS TEXTING, MMS TEXTING, OR PRE-RECORDED AND AUTO-DIALED CALLS.

TO THE EXTENT PERMITTED BY LAW, WASHINGTON GAS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. NO STATEMENTS FROM WASHINGTON GAS OR ITS EMPLOYEES, REPRESENTATIVES, OR AGENTS MAY INCREASE THE SCOPE OF THE ABOVE WARRANTIES OR CREATE ANY NEW WARRANTIES. IF THIS DISCLAIMER IS INVALID UNDER APPLICABLE LAW, ANY IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THIRTY (30) DAYS FROM THE DATE THAT YOU FIRST USE OUR TEXT ALERTS SYSTEM.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL WASHINGTON GAS, ITS PARENT AND AFFILIATE COMPANIES, AND EACH OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THE TEXT ALERTS SERVICE OR FROM TECHNICAL FAILURES OR DELAYS OF ANY KIND RESULTING FROM THE OPERATION, USE, OR THE INABILITY TO USE OUR TEXT ALERTS SERVICE, FROM THE UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY REGARDING SMS TEXTING, MMS TEXTING OR PRE-RECORDED AND AUTO-DIALED CALLS, OR ANY OTHER MATTER RELATED TO SMS TEXTING, MMS TEXTING OR PRE-RECORDED AND AUTO-DIALED CALLS, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Reports of Emergency Conditions to Washington Gas
YOU AGREE THAT YOU WILL NOT SEND EMERGENCY NOTIFICATIONS OR MESSAGES, SUCH AS REPORTING THE PRESENCE OF A KNOWN OR SUSPECTED GAS LEAK, TO WASHINGTON GAS BY SMS OR MMS TEXT. YOU AGREE THAT ANY REPLY FROM WASHINGTON GAS TO SUCH A MESSAGE, OR THE ABSENCE OF A REPLY FROM WASHINGTON GAS TO SUCH A MESSAGE SHALL BE CONSTRUED AS THE FAILURE OF WASHINGTON GAS TO RECEIVE YOUR EMERGENCY MESSAGE. YOU AGREE THAT IF YOU SMELL GAS OR OTHERWISE SUSPECT A GAS LEAK, YOU WILL CALL 911 AND WASHINGTON GAS AT ITS GAS EMERGENCY LINE: 844-WASHGAS (844-927-4427) – SELECT OPTION 1.

Your use of our text alerts service is pursuant to a limited, non-exclusive, revocable license and is subject to these Text Terms and Washington Gas’ Privacy Policy [https://www.washingtongas.com/privacy], either of which may be amended by the Company without prior notice to you. If you do not agree, you may not establish or use our text alerts service.


Miscellaneous

All matters relating to the Text Alert Service, and all matters arising out of or related thereto, including all tort claims, will be governed by and interpreted in accordance with the substantive laws of the Commonwealth of Virginia without reference to conflicts of law. Actual or attempted unauthorized use of the Text Alert Service may result in criminal and/or civil prosecution.

No waiver by Washington Gas of any breach of the Text Terms will be held to be a waiver of any other or subsequent breach and shall not limit Washington Gas’ rights with respect to such breach or any subsequent breaches. 

Washington Gas reserves the right to change the Text Terms. You can review the most current version of the Text Terms at any time by visiting https://www.washingtongas.com/terms. Updates or changes to the Text Terms will be effective when posted on the Site. Your continued use of the Text Terms after any changes in such terms and conditions shall constitute your consent to such changes.
